Reference this office letter No. 3/7-EC-IV-2003/1020-38 dated 24/9/03 vide which the Swasthya Kalyan Samiti, at Institution level were Constituted as sub committee of Governing and Executive Council of Distt. Health & Family Welfare Societies.

As envisaged under NRHM, to support the Distt. Health and Family Welfare Society an integrated Swasthya Kalyan Samiti at District Hospital/ Sub District Hospital are now reconstituted. The Swasthya Kalyan Samiti shall be responsible for Planning & Managing all health activities of District and Sub District Hospitals in the State. This Samiti of District Hospital and Sub District Hospital shall also ensure Inter-Sectoral Convergence.

The revised constitution of Swathya Kalyan Samiti, District / Sub District Hospitals is enclosed with the direction to get it registered at the earliest.

Subject: - Re-constitution of Swasthya Kalyan Samiti (District Hospital) & Swasthya Kalyan Samiti (Sub District Hospital).

The National Rural Health Mission seeks to provide effective health care to the rural population, especially the disadvantaged groups including women and children, by improving access, enabling community ownership and demand for services, strengthening public health systems for efficient service delivery, enhancing equity and accountability and promoting decentralization.

Swasthya Kalyan Samiti (SKS) is a simple yet effective management structure. This committee, which would be a registered society, acts as a group of trustees for the hospitals to manage the affairs of the hospital. It consists of members from local Panchayati Raj Institutions (PRIs), NGOs, local elected representatives and officials from Government sector who are responsible for proper functioning and management of the hospitals. SKS is free to prescribe, generate and use the funds with it as per its best judgment for smooth functioning and maintaining the quality of services and subject to further instructions from Govt./ State Health Society from time to time.

Meetings:

· Meeting of SKS shall be convened by the Member Secretary by giving clear seven days notice in writing along with the agenda specifying the business to be transacted, the date, time and venue of the meeting.
· Swasthya Kalyan Samiti will meet once in every month. The meeting will be held on a fixed day. All members must be aware of the day of next meeting.
· PMO/MS I/c of District/ Sub District Hospital will keep the contact number of all the members and shall ensure their participation.

Term of Members:

The term of official members will be the time they hold the office by virtue of which they are members. A member of the Samiti shall cease to be member if s/he resigns, becomes of unsound mind, become insolvent or convicted of a criminal offence involving moral turpitude or removal from the post by the virtue of which s/he was holding the membership. No member of the Samiti shall be entitled to any remuneration.

Quorum:

One third of the member of the Samiti including the substitutes nominated by the Chairman present in the meeting shall form a quorum at every meeting of the SKS.

Functions/ Powers of SKS:

The Swasthya Kalyan Samiti (DH & SDH) shall monitor, evaluate and co-ordinate the work of Hospital under its jurisdiction and will serve as link to the Distt. Health Society. It will review the progress in implementation of NRHM and various heath schemes and policies.

The following minimum business shall be brought forwarded and disposed off in every meeting.

· Compliance to Standards and Protocols issued by the Government/ State Health Society.
· Shall ensure compliance to Indian Public Health Standard.
· Review OPD/ IPD and Institutional delivery service performance of Hospital and service delivery targets.
· Preparation of action plan.
· Review of expenditure of funds as per guidelines.
· Supervision and monitoring of work done out of SKS funds.
· SKS and Chairman shall enjoy all such powers as may be delegated to him/her by the State Health Society of Governing body of District Health and Family Welfare Society.
· will review the status of funds available with the SKS, untied funds under NRHM, user money & other State schemes and utilization status thereof. The scheme-wise availability of funds, expenditure and outcomes will be planned & reviewed.
· will review status of collection & utilization of User Charges
· it will review the availability, distribution and consumption of medicine and stock position thereof.
· will review the other development works of Health Department in respect of its estimated cost, date of commencement & completion of project. The work of agency shall also be reviewed in the meeting.
· Review compliance of citizen charter displayed in the hospital and effectiveness of grievances redressal mechanism.
· Shall take measures to increase transparency in financial and operational management of the hospital.
· Appropriate relaxations for BPL patients to be ensured, as per State policy.

In the monthly meeting, the complaint/suggestion box shall be opened. The redressal of complaints and grievances, if any will be resolved and necessary remedial steps for improvement will be initiated at the level of Samiti. The matter will be referred to the Distt. Health Society wherever required.

Record Maintenance:

The SKS shall maintain the following record and maintain the accounts on Double Entry System .

· Proceeding Register
· Cash Book
· General Ledger

Financial Powers:

The Chairman of SKS shall exercise the financial powers delegated to him by the Govt./ State Health Society/ District Health & Family Welfare Society from time to time for incurring expenditure under State Budget, NRHM and User Charges etc. respectively.

Resource Mobilization:

The funds of the Society shall consist of the following:

· Grants and funds received under NRHM.
· Receipts from such User Fee from time to time including lease money and funds from other sources.
· Grant-in-aid from the State Government and/or State level society (societies) in the health sector and/or District Health Society.
· Grants and donations from trade, industry and individuals.

Provision of enabling rights, vesting assets & authorizing services:

The Govt. may authorize transfer of existing facilities and assets free of cost and without any liability to the SKS of the concerned hospital. In most hospitals, the principle reasons for malfunctioning and deteriorating services are the inability to spend on new infrastructure for upgradation & modernization, paucity of funds for emergencies, gross mismanagement of resources and lack of motivation. Being a service oriented facility, it needs to permit and grant specific rights to allow freedom for operations and management. The SKS should be enabled with the decision making right to invest in order to meet service requirements.

Accounts and Audit

· The Samiti shall cause regular accounts to be kept of all its monies and properties in respect of the affairs of the Samiti.
· The accounts of the Samiti shall be audited annually by a Chartered Accountant firm included in the panel of Chartered Accountants drawn by the designated authority of the Central/ State Government, if any.
· The report of such audit shall be communicated by the Auditor to the Samiti, which shall submit a copy of the Audit Report along with its observation to the Chairperson SKS, Deputy Commissioner cum Chairman District Health & Family Welfare Society.
· Any expenditure incurred in connection with such audit shall be payable by the SKS to the Auditors.
· The Chartered Accountant or any qualified person appointed by the Govt. of India/State Government in connection with the audit of the accounts of the Samiti shall have the same rights, privileges and authority in connection with such audit as the Auditor General of the State has in connection with the audit of Government accounts and in particular shall have the right to demand the production of books, accounts, connected vouchers and other necessary documents and papers.

Bank Account

The account of the SKS DH & SDH shall be opened in a bank approved by the Govt. of India/ State Govt./ Governing Body of the District Health and Family Welfare Society. All funds shall be credited into the SKS account. However, the cheques at the level of SKS District Hospital shall be jointly signed by the Co-Chairman and Member Secretary. In the case of SKS Sub Divisional Hospital the cheques shall be signed jointly by Chairperson and Member Secretary.

Annual Report

A draft Annual Report and the yearly accounts of the Samiti shall be placed before the Governing Body of District Health and Family Welfare Society at its ensuing meeting that may be held in the first quarter of every financial year.

A copy of the annual report and audited statement of accounts as finally approved by the Governing Body of District Health and Family Welfare Society shall be forwarded within six months of the closure of a financial year to the following:

· Deputy Commissioner ( Chair-person, Governing Body of DH&FWS)
· Chair-person, Executive Body (DH&FWS).
· Mission Director, NRHM

Suits and proceedings

· The Samiti may sue or be sued in the name of Samiti through its Member Secretary.
· No suit or proceedings shall abate by the reason of any vacancy or change in the holder of the office of the Chair-person or Member Secretary or any office bearer authorized in this behalf.
· Every decree or order against the Samiti in any suit or proceedings shall be executable against the property of the Society and not against the person or the property of the Chair-person, Member Secretary or any office bearer of the Samiti.
· Nothing in sub-rule as above shall exempt the Chair-person, Member Secretary or office bearer of the Samiti from any criminal liability or entitle him/her to claim any contribution from the property of the Samiti in respect of any fine to be paid by him/her on conviction by a criminal court.

Amendments

The Samiti may alter or extend the purpose for which it is established and/or the Rules of the Samiti, provided that such amendment shall only be carried out through the procedure set out in rule as above.

Dissolution

· The Governing Body District Health and Family Welfare Society may resolve to dissolve the Samiti by bringing a proposal to that effect in a special meeting to be convened for the purpose, provided that the proposal for dissolution has been duly approved /endorsed through the process prescribed for amendment as set out in rule as above.
· The dissolution proceedings shall be made in accordance with the provisions of the Act as amended from time to time in its application in the State.
· Upon the dissolution of the Society, all assets of the Society, after the settlement of all its debts and liabilities, shall stand reverted to the State Government for such purposes as it may deem fit.

Contracts

· All contracts and other instruments for and on behalf of the Society shall be subject to the provisions of the Act, be expressed to be made in the name of the Society and shall be executed by the persons authorized by the Governing Body (District Health & Family Welfare Society).
· No contracts for the sale, purchase or supply of any goods and material shall be made for and on behalf of the Society with any member of the Society or his/her relative or firm in which such member or his/her relative is a partner or shareholder or any other partner or shareholder of a firm or a private company in which the said member is a partner or director.

Common seal

The Samiti shall have a common seal of such make and design as the Governing Body may approve.

Government power to review

The State Health Society / District Health Society shall review, monitor and evaluate the performance of the Swasthya Kalyan Samities at the District/ Sub District levels.
